Terms of Use
Health disclaimer. INDX is not a medical device. It does not diagnose, treat, cure, or prevent any disease, and it does not provide medical advice. Never use it to decide insulin or other medication doses, and never rely on it to detect or respond to low blood glucose. Always follow the advice of a qualified clinician and the instructions supplied with your CGM sensor.
1. Agreement
These terms are a legal agreement between you and INDX Biotechnology Company Limited, Unit 301, 8 Jordan Road, Jordan, Hong Kong ("INDX", "we", "us") covering your use of the INDX iPhone app and this website. By using the app or submitting the optional waitlist form, you accept these terms. If you do not accept them, do not use the app or submit the form.
2. Development status
INDX is pre-release software. Features may change or be withdrawn, data formats may change, and you may encounter defects. Pre-release builds distributed through TestFlight are additionally subject to Apple's TestFlight terms and to any instructions we send to testers. Do not rely on a pre-release build for anything important.
Joining the optional launch waitlist does not create an app account or guarantee early access. You can unsubscribe or request deletion of your waitlist entry by contacting us.
3. Eligibility and your account
You must be old enough to form a binding contract in your jurisdiction to use INDX. Signing in is optional; the app works without an account. If you create one, you are responsible for keeping your device and sign-in credentials secure, and for activity carried out under your account. Tell us promptly if you believe your account has been compromised.
4. Your data
How we handle your data is described in the privacy policy, which forms part of these terms. In short: your data stays on your device unless you enable encrypted backup, and health data in the cloud is encrypted with a key we never receive — which means we cannot recover it for you if the key is lost.
5. Acceptable use
You agree not to:
- use INDX in a way that breaks any law or regulation, including medical device and data protection law;
- attempt to access another person's data, or to interfere with the security or availability of our systems;
- reverse engineer, resell, or redistribute the app except as permitted by law or by an applicable open-source licence;
- use the AI assistant to obtain advice for a medical emergency, or in place of professional care.
6. Third-party components and services
INDX uses Apple Health and, optionally, a CGM sensor's Bluetooth interface, each governed by its own provider's terms. INDX also includes open-source components; the licences and required attribution notices are listed in the app's third-party notices. Nothing in these terms limits rights you may have under those licences.
7. Our intellectual property
The INDX name, logo, and app are owned by us or our licensors. These terms give you a personal, non-transferable, non-exclusive licence to use the app for your own non-commercial purposes. All rights not expressly granted are reserved.
8. Availability and changes
We may update, suspend, or discontinue the app or any feature at any time. We may also update these terms; when we do, we will revise the effective date above, and material changes will be communicated in the app before they take effect. Continuing to use INDX after a change means you accept the updated terms.
9. Disclaimers
To the fullest extent permitted by law, INDX is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. We do not warrant that readings displayed by INDX match your sensor or your clinician's measurements, or that the app will be free of errors.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or health outcomes, arising from your use of or inability to use INDX. Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
11. Governing law
These terms are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have exclusive jurisdiction over any dispute arising from them, without affecting any mandatory consumer protection rights you have where you live.
